Welcome to AMCO Delivery. This website (amcodelivery.com) and associated services are owned and operated by AMCO Delivery LLC ("AMCO Delivery," "we," or "us"). By using our platform or services, you agree to these Terms of Service.
1. Agreement to Terms
These Terms constitute a legally binding agreement between you and AMCO Delivery. By accessing our website or using our services, you agree to be bound by these Terms and any future updates.
2. Changes to Terms
We may update these Terms at any time. Changes take effect immediately upon posting. Continued use of our services after changes are posted constitutes your acceptance.
3. Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
4. Acceptable Use
You agree to use our platform and services only for lawful purposes. You may not:
- Engage in fraud or illegal activity
- Interfere with the operation of our platform
- Attempt to damage or disrupt our systems
- Provide false information during registration or order placement
5. Account Registration
To access certain services, you may need to create an account. You agree to:
- Provide accurate and complete information
- Keep your account information up to date
- Maintain the security of your login credentials
- Be responsible for all activity under your account
6. Payment Terms
All fees are due immediately and are non-refundable unless otherwise agreed in writing. Accepted payment methods include check, wire transfer, ACH, and credit card. Overdue balances are subject to a late fee of 2% per month or the maximum rate permitted by law.
7. Claims for Lost or Damaged Goods
Claims for missing or damaged items must be submitted in writing within 10 business days of delivery. All claims must include the order number, pickup date, description of the issue, and documented replacement value. AMCO Delivery's maximum liability per delivery is $100.
8. Restricted Items
The following items are not accepted for shipment:
- Firearms and ammunition
- Fireworks and explosives
- Hazardous or flammable materials (unless pre-approved)
- Cash, currency, or negotiable instruments
- Live animals
- Stolen goods
- Items prohibited by federal, state, or local law
9. Terms of Carriage
Cancellations: Orders may be canceled before the courier arrives at the pickup location. Cancellations after courier arrival may be charged in full.
Re-delivery: If delivery cannot be completed, we will contact the sender for instructions. Return-to-sender trips and re-delivery attempts are subject to additional charges.
Wrong Address: The sender is responsible for providing the correct delivery address. AMCO Delivery is not liable for deliveries made to an incorrect address provided by the sender.
Refusal of Delivery: AMCO Delivery reserves the right to refuse any shipment that may violate these Terms or applicable law.
Inspection: We reserve the right to open and inspect any package at our discretion.
10. Medical and Biohazardous Materials
AMCO Delivery accepts medical specimens, pharmaceuticals, and dry ice shipments. All such materials must be properly packaged and labeled in compliance with OSHA, HIPAA, and DOT regulations. Shippers are responsible for providing accurate classification information for all specimens and materials.
11. Disclaimer of Warranties
Our services are provided "as is" without any warranties, express or implied. AMCO Delivery does not guarantee uninterrupted, error-free service. We are not responsible for delays caused by circumstances beyond our control, including internet failures, weather events, or other force majeure conditions.
12. Limitation of Liability
AMCO Delivery's total liability for any claim arising under these Terms shall not exceed the total amount paid by you to AMCO Delivery in the six months prior to the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages of any kind.
13. Indemnification
You agree to indemnify and hold AMCO Delivery, its officers, employees, and agents harmless from any claims, damages, or expenses arising from your violation of these Terms, misuse of our services, or violation of any third-party rights.
14. Force Majeure
AMCO Delivery is not liable for delays or failures resulting from causes beyond our reasonable control, including acts of God, war, natural disasters, labor shortages, or infrastructure failures.
15. Dispute Resolution
These Terms are governed by the laws of the State of Washington. Any disputes shall be resolved in the courts of King County, Washington. For claims under $10,000, either party may elect binding arbitration conducted by telephone or written submission.
16. General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement between you and AMCO Delivery regarding use of our services. AMCO Delivery may assign these Terms at any time. You may not assign your rights without our written consent.
